The legal position, which technically could be solved by derogation, is really a smokescreen for what happened in the UK. By the mid 1970’s the Department of Education ( don’t worry it keeps changing its designation, but for this purpose, I’ll call it DOE throughout), had from the mid 70’s made its position crystal clear. It believed that equal opportunities legislation would bring back the cane for girls, and they wrote a whole series of internal memos to that effect. I quoted from one on this site some time ago in respect of Scotland and the tawse in issue……which showed they believed total abolition preferable ( in their case not on psychological grounds, but pure political cowardice).
