Elsewhere in the Act governing bodies are made responsible for the implementation of all, aspects of the act, from playing field regulations to academic requirements to student discipline which takes place on their premises and, in specified circumstances, off it. Moreover, the definition of the pupil ( para 5 ff) seems to relate to the pupils legal relationship to the school , not the member of staff ( ie in a fee-paying school if the student’s fess are paid by the LEA notwithstanding the right of an independent school to maintain corporal punishment he/she may not be beaten without an offence being committed) even though other children attending under different legal arrangements may be legally beaten.
