Moreover, the definition of the pupil ( para 5 ff) seems to relate to the pupils legal relationship to the school , not the member of staff ( ie in a fee-paying school if the student’s fess are paid by the LEA notwithstanding the right of an independent school to maintain corporal punishment he/she may not be beaten without an offence being committed) even though other children attending under different legal arrangements may be legally beaten.
