Mr. Justice Waller, giving judgment, said that the tribunal was entitled to conclude that Mrs. Byrd was an equal party in running the school and responsible for what happened. She was one of two principals, taking an active part in administration.
She had taken the younger boys to witness an incident in which a naked boy was thrown twice into the school swimming pool and made to run around rough ground of a garden near by. She made no protest, did not withdraw the boys, and did not give evidence that there was any other explanation than that she assented.
