Mr. BRIGGS, on behalf of the plaintiff, said he was prepared to accept the verdict of the majority.
Mr. Bracey-Wright declined to do so.
After some further deliberation the jury, returned to Court and said that there was no prospect of their agreeing upon a verdict.
MR. JUSTICE SCRUTTON accordingly discharged them, exempting them from further service for five years.
Mr. BRIGGS asked his Lordship to facilitate an early retrial of the case.
Mr. JUSTICE SCRUTTON aid that, having regard to the state of the cause list, if the case were entered for trial it would be heard in a very short time.
