The allegations made were that the plaintiff had flogged sick and convalescent children in the infirmary with what was described as “a fivetailed lash.”
The defence was that the statements made were true in substance and in fact; that the opinions expressed were fair comments upon matters of public interest, and that the occasion of the publication was privileged.
