Parliament decided to prohibit CP in state schools only because (once they had persuaded themselves, wrongly in my view, that you couldn’t have some pupils who could be whacked and others in the same class who couldn’t because their parents objected) there didn’t at the time seem to be any other practical way of providing free state education for students whose parents were philosophically opposed to CP — not because CP itself had been found to be unlawful.
