With respect to CP, I think “abuse” is too strong a word unless the term is well defined. On the other hand a focus on what may or may not have been legal at the time is setting the bar too low.
I would prefer to identify some markers as to where the use of CP was wrong – eg excessive, clearly unfair or too severe. Personally, I am more concerned where this occurred at the primary level than the secondary as I believe there is a greater likelihood of real harm.
